If he gives his employees 1099 instead of w2 they are treated as independent contractors and so the federal minimums don't apply and at 12000 a year they dont make enough to even have to pay income tax plus depending on all the expenses the employer covers it might be a way to live.

This is the problem with mandatory minimums on wages. Lots of people would be happy to work full time just to have food shelter and transportation taken care of… but to keep the tax base high everything must be equated to a minimum of dollars.
